Why a Written Agreement Is Essential

Verbal agreements in co-parenting are the number one source of conflicts. "But I understood that..." is the phrase that precedes countless disputes. A clear, detailed written agreement acts as a neutral arbiter when disagreements arise.

Structure of a Complete Agreement

Section 1: General Information

  • Data of both parents
  • Data of each child included in the agreement
  • Effective date and validity period
  • Periodic review mechanism

Section 2: Residence and Calendar

  • Child's primary residence
  • Detailed weekly/biweekly calendar
  • Vacation distribution (summer, winter, spring)
  • Special dates (birthdays, holidays, Father's/Mother's Day)
  • Protocol for changes and compensations

Section 3: Decision Making

  • Decisions requiring agreement from both (school change, medical operation, international travel)
  • Decisions each parent can make independently
  • Emergency protocol
  • Tiebreaker in case of disagreement

Section 4: Communication

  • Main co-parenting communication channel (e.g., Family Bridge)
  • Maximum response time
  • Protocol for urgent communications
  • Rules about direct communication with children

Section 5: Financial Aspects

  • Monthly support and payment method
  • Ordinary expenses included in support
  • Definition of extraordinary expenses
  • Process for approving extraordinary expenses
  • Periodic review of support

Writing Tips

Use specific, concrete language. Avoid vague terms like "reasonable" or "usual" without defining them. Include examples when necessary. Think about specific situations that have generated conflicts and address them explicitly.

Judicial Approval

For the agreement to have legal force, present it to the family court for approval. An approved agreement is judicially enforceable if one of the parties doesn't comply.
